Terms of Service

eSchoolNest is a school management platform wholly owned and operated by VudaTech, a registered IT services company in India (GST: 37BLTPV2588K1ZW). All contractual obligations, data responsibilities, and service commitments described in these Terms are made by VudaTech on behalf of the eSchoolNest platform.

1. Acceptance of Terms

By accessing or using eSchoolNest ("the Platform"), operated by VudaTech ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

eSchoolNest, a product of VudaTech, is a cloud-based school management platform that provides tools for student management, attendance tracking, examination management, fee collection, timetable scheduling, teacher management, and parent communication. The Platform is designed for use by schools, educational institutions, their staff, and authorised parents/guardians.

3. Eligibility

  • The Platform is intended for use by schools and educational institutions.
  • Individual users must be at least 18 years old, or use the Platform under the supervision of a parent, guardian, or school administrator.
  • By registering, you represent that you have the authority to bind your school or institution to these terms.

4. Account Registration and Security

  • Schools are onboarded through our team — accounts are created by eSchoolNest administrators.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must immediately notify us of any unauthorised access to your account.
  • We reserve the right to suspend accounts that violate these terms.

5. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these terms. You shall not:

  • Use the Platform for any illegal or unauthorised purpose.
  • Attempt to gain unauthorised access to other accounts, systems, or networks.
  • Upload viruses, malware, or any harmful code.
  • Interfere with the Platform's security features or proper functioning.
  • Share sensitive student data outside the Platform without proper authorisation.
  • Reverse-engineer, decompile, or disassemble any part of the Platform.
  • Use automated tools to scrape or extract data from the Platform.

6. Data Ownership

  • Your Data: All data you enter into the Platform (student records, attendance, grades, etc.) remains your property. You grant us a limited licence to process this data solely to provide the service.
  • Platform Content: The Platform's software, design, logos, and documentation are owned by eSchoolNest and protected by intellectual property laws.
  • Data Export: You may export your data at any time through the Platform's export features.

7. Subscription and Payment

  • eSchoolNest offers affordable monthly and yearly subscription plans.
  • Pricing is communicated during the onboarding process and is based on your school's requirements.
  • Payments are due as per the agreed schedule. Late payments may result in temporary service suspension.
  • All fees are exclusive of applicable taxes unless stated otherwise.

8. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service.
  • Scheduled maintenance will be communicated in advance whenever possible.
  • We are not liable for service interruptions due to factors beyond our control (force majeure, internet outages, etc.).

9. Data Privacy and Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to the practices described therein.

10. Limitation of Liability

To the maximum extent permitted by law, VudaTech (operating eSchoolNest) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform.

Our total liability for any claim arising from or related to the service shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless VudaTech (operating as eSchoolNest), its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, violation of these terms, or infringement of any third-party rights.

12. Termination

  • Either party may terminate the subscription with 30 days written notice.
  • We may immediately terminate or suspend access for violation of these terms.
  • Upon termination, your data will be available for export for 90 days, after which it will be permanently deleted.

13. Modifications to Terms

VudaTech reserves the right to modify these terms at any time. Material changes will be communicated via email to registered administrators at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
